View Full Version : No noise on your own property, your neighbors are trying to kill things

ITALY, Texas - An Ellis County man has been ordered by a judge to keep the noise down on his property during deer season after he was found guilty of a misdemeanor charge of disrupting hunters.

An Ellis County jury found Galen Morris, 38, guilty on Tuesday of violating one count of the state Sportsman's Rights Act. He was found not guilty of a second, similar charge.

The judge in the case ordered Morris to make sure his children don't disturb hunters on a neighboring property by playing loud music or driving four-wheelers before noon or after 4 p.m. during deer season, which starts in November. Morris was also issued a $250 fine and a year of probation.

"I kind of got mixed feelings out of it," Morris said. "Basically what they're saying is, during deer season you got to keep your kids indoors. You could sneeze and scare a deer off."

The Sportsman's Rights Act makes it illegal "to intentionally interfere with another person lawfully engaged in the process of hunting or catching wildlife."

Peggy Carroll, part owner of a ranch neighboring the Morris property, said the court's decision is fair. She said she hopes the noise restrictions and threat of jail time will keep it quiet for the hunters who use her land.

But Morris' lawyer, Waxahachie attorney Mark Griffith, said he's advising his client to appeal.

"This is just unbelievable to me," Griffith said. "This is really about what rights do you have on your own property."

Um.... is there a response to this, besides WTF? It's MY land, I bought it, and I'm gonna do WHATEVER I want on it! Screw the hunters! If they don't like to hunt that ranch, they can find another one. Besides, there are deer all around me every day at work. We drive those Kawasaki Mules all over the place and it doesn't seem to bother the deer. Half the time you have to slow down to avoid hitting them!

I guess it boils down to whether the owner and his kids were deliberately making noise to interfere with the hunting on neighboring property or just having fun. You know, there is the concept of "your rights end where the next person's begin". I can't let my dogs bark incessantly at night if it bothers the neighbors even though they're on my land.
BTW, Italy is only about 10 miles from my house. Not that it matters.

Thats exactly what it boils down to. If they didn't do this the peta people would be sitting outside public hunting grounds with megaphones scaring all of the deer.

Um........I know this is off topic........but wouldn't you want your kids inside the house, when there are a bunch of drunken men with guns shooting?

I'm not sure if it's that easy in some areas. My family has a house in vermont and we used to have a big, black, newfoundland/st bernard mix. We were warned, by more than one person, to make sure we always stayed with him and that he was on a short leash, as hunters could mistake him for a baby bear and shoot him. This wasn't just if he walked off our property either.

Thats exactly what it boils down to. If they didn't do this the peta people would be sitting outside public hunting grounds with megaphones scaring all of the deer.

I don't see why they shouldn't be able to do that in public places. It's like protesting. Protesters can scare away clients from clinics, customers from entering buildings etc. As long as they aren't actually blocking the entrance then they're fine.

But I'm suprised they never decide to go hunting but be intentionally bad shots. That way they could pretend to be hunting but are just scaring away everything.

Alanzo........I live in the city. One of my brothers lives way north, lots of land. They close the scools for two reasons.

1. Because the kids are going to skip school anyway to hunt.
2. Because it's not safe to walk to school.

I can see your problem with the dog though. Beautiful breed! He wouldn't be running in hunting season, if he was mine. A week on a short leash by the house is where he would be.
